1. Acceptance of Terms

By accessing or using any SeaByte Labs, LLC ("SeaByteLabs," "we," "our," or "us") websites, mobile applications, APIs, or related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree, do not use the Services.

2. Definitions

• "Account" means the profile you create to access certain features of the Services.
• "Content" means any text, data, code, images, or materials displayed, stored, or transmitted via the Services.
• "User Content" means content you submit, upload, or otherwise make available through the Services.

3. Eligibility & Accounts

• You represent that you are at least the age of majority in your jurisdiction or have parental/guardian consent.
• You must provide accurate, current information when creating an Account and keep it updated.
• You are responsible for safeguarding login credentials and for all activities occurring under your Account.
• Notify us promptly at support@seabytelabs.com of any unauthorized use or security breach.

4. Acceptable Use

You agree NOT to:

• Attempt to probe, scan, or test the vulnerability of any system or network.
• Interfere with or disrupt the integrity or performance of the Services.
• Use automated scripts to collect data outside permitted API usage.
• Transmit malware, ransomware, or other harmful code.
• Infringe upon another party's intellectual property or privacy rights.

5. Intellectual Property

All right, title, and interest in and to the Services (including software, design, logos, and trademarks) are owned by SeaByte Labs, LLC or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Services for lawful internal purposes. No other rights are granted. You may not reverse engineer, decompile, disassemble, or attempt to derive source code except where permitted by law.

6. User Content & Feedback

You retain ownership of User Content. By submitting User Content, you grant SeaByteLabs a worldwide, non-exclusive, royalty-free license to use, host, reproduce, display, and distribute such content solely to operate, improve, and promote the Services. If you provide feedback or suggestions, we may use them without obligation or compensation.

7. Third-Party Services & Links

The Services may integrate or link to third-party tools or resources. We are not responsible for third-party content, availability, or practices. Your use of third-party services is governed by their separate terms and policies.

8. Privacy & Data

Use of the Services is subject to our Privacy Policy. You may request deletion of certain personal data pursuant to our Data Deletion page. By using the Services, you consent to the collection and use of your data as described therein.

9. Service Changes & Availability

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice. We are not liable for any downtime, loss of data (except as required by law), or impacts caused by maintenance or updates.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SEABYTELABS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNT YOU PAID TO US IN THE 3 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless SeaByteLabs and its officers, directors, employees, and agents from any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) violation of these Terms; or (c) infringement or violation of any third-party rights.

13. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms, suspected fraud, legal compliance, or operational reasons. Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive (e.g., Intellectual Property, Limitation of Liability) will remain in effect.

14. Changes to Terms

We may update these Terms periodically. The "Last Updated" date reflects the latest revision. Material changes may be communicated via email or in-app notices. Continued use after changes constitutes acceptance.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law rules. Any dispute not resolved informally will be submitted to binding arbitration in Delaware (unless prohibited by law), except that either party may seek injunctive relief for intellectual property or security matters in a court of competent jurisdiction.
